Acceptable Use Policy

Acceptable Use Policy

Last updated: January 1st, 2018

This Acceptable Use Policy (the “Policy”) governs what may and may not be done using the Subscribe Funnels platform. It forms part of, and is incorporated by reference into, the Terms of Service. Capitalized terms have the meanings given in the Terms of Service.

Violating this Policy is a material breach of the Terms of Service. We may remove content, suspend or terminate accounts, and take any other action we consider appropriate, immediately and without notice or refund.

1. Who This Policy Applies To

1.1 This Policy applies to every person and entity that accesses or uses the Services, including Subscribers, Sub-Users, White-Label Partners, End Clients, affiliates, agencies, contractors, and anyone acting on their behalf.

1.2 It applies to every Funnel, page, form, file, asset, script, message, and item of Subscriber Content created, published, hosted, or transmitted using the Services, whether public, unlisted, password-protected, in draft, or served from a custom or white-labeled domain.

1.3 Where you build or host Funnels for clients, or resell the Services under your own brand, you are responsible for your clients’ compliance with this Policy as if their conduct were your own.

2. Your Responsibility

2.1 You are solely responsible for everything published through your account. We do not pre-screen, review, monitor, or approve Subscriber Content. Nothing in this Policy creates any obligation for us to monitor, and any monitoring we do perform is discretionary and does not shift responsibility to us.

2.2 This Policy is not a compliance checklist. It sets out conduct we prohibit for our own protection. It is not exhaustive, it is not legal advice, and complying with it does not mean your Funnel complies with any law. Determining what the law requires of your business is your responsibility, and you should obtain your own professional advice.

2.3 Conduct that is not expressly listed here may still violate this Policy. We may act against any use of the Services that we consider, in our sole discretion, harmful, unlawful, abusive, deceptive, or damaging to us, to other subscribers, to Visitors, or to our infrastructure, service providers, or reputation.

2.4 You must comply with all laws applicable to you and to every jurisdiction you target, including those governing advertising, consumer protection, e-commerce, privacy, data protection, electronic marketing, telemarketing, taxation, and the goods and services you offer.

3. Prohibited Content

You must not use the Services to create, publish, host, store, distribute, or link to content that:

  • sexually exploits or abuses a minor, or depicts a minor in any sexualized manner, in any form and without exception;
  • is pornographic, sexually explicit, or constitutes adult services, escort services, or sexual services;
  • depicts or promotes non-consensual sexual activity, human trafficking, forced labor, or sexual violence;
  • promotes, incites, glorifies, threatens, or provides instruction for violence, terrorism, or violent extremism;
  • promotes or incites hatred, harassment, or discrimination against any person or group on the basis of race, ethnicity, national origin, religion, disability, age, sex, gender identity, sexual orientation, veteran status, or any other protected characteristic;
  • harasses, bullies, stalks, defames, threatens, doxxes, or is intended to intimidate any person;
  • promotes self-harm, suicide, eating disorders, or dangerous behavior;
  • depicts gratuitous violence, gore, or animal cruelty;
  • is unlawful, or facilitates any unlawful act;
  • infringes or misappropriates any patent, copyright, trademark, trade secret, moral, publicity, or privacy right; or
  • constitutes or facilitates the sale of firearms, firearm components, ammunition, explosives, weapons, controlled substances, illegal drugs, drug paraphernalia, counterfeit goods, stolen goods, endangered species, or human organs or tissue.

4. Deceptive and Unfair Marketing Practices

This section reflects the practices most likely to attract regulatory attention on a funnel platform. You must not:

4.1 Make false, unsubstantiated, or misleading claims

  • Make any claim about a product, service, or result that you cannot substantiate with competent and reliable evidence at the time the claim is made.
  • Make earnings, income, profit, or lifestyle claims that are false, misleading, or not representative of what typical purchasers achieve. Where you present results, you must disclose the generally expected result, clearly and conspicuously and in close proximity to the claim.
  • Make health, medical, disease treatment, cure, prevention, or weight loss claims that are unsubstantiated or that are not permitted for the product in question.
  • Misrepresent your identity, qualifications, credentials, licensure, awards, certifications, affiliations, endorsements, or years in business.
  • Misrepresent the nature, characteristics, origin, quality, or availability of what you are selling.

4.2 Use false endorsements or testimonials

  • Publish fabricated, purchased, incentivized-but-undisclosed, or materially altered testimonials or reviews.
  • Present stock imagery, actors, or AI-generated personas as real customers without clear disclosure.
  • Fail to disclose a material connection between you and any endorser, reviewer, or affiliate.
  • Suppress or selectively filter negative reviews while presenting the remainder as representative.
  • Display trust badges, media logos, certifications, security seals, or “as seen on” claims you are not entitled to display.

4.3 Use fake urgency or manufactured scarcity

  • Display countdown timers that reset, restart, or do not correspond to a genuine deadline.
  • Represent stock levels, seat counts, remaining spots, or applicant numbers that are not accurate.
  • Represent a price as a limited-time discount when it is the ordinary price, or reference a “regular” or “compare at” price at which the item is not genuinely offered.
  • Display live sales, visitor-count, or social-proof notifications that are simulated or not derived from real events.

4.4 Use dark patterns or coercive design

  • Design interfaces that obscure material terms, disguise advertising as editorial or organic content, or make declining an offer confusing or difficult.
  • Pre-check consent boxes, or bundle consent to marketing or to additional purchases with acceptance of terms.
  • Add items to an order that the Visitor did not affirmatively select.
  • Use confirmshaming, misdirection, or deliberately obstructive flows to obtain consent or prevent cancellation.

4.5 Operate fraudulent or predatory schemes

  • Phishing, credential harvesting, or any attempt to obtain information by impersonation or deception.
  • Pyramid schemes, chain letters, Ponzi schemes, matrix programs, gifting circles, or any scheme in which returns depend primarily on recruitment.
  • Advance-fee, romance, invoice, employment, prize, sweepstakes, lottery, or inheritance fraud.
  • Fake giveaways or contests, or contests operated in breach of applicable law.
  • Cryptocurrency, forex, or investment schemes involving guaranteed returns, false trading records, or fabricated performance data.

5. Offers, Pricing, and Subscription Billing

Where a Funnel sells anything, you must:

  • disclose the total cost, including all mandatory fees, shipping, and taxes, clearly and conspicuously before the Visitor commits to purchase;
  • disclose all material terms of the offer before purchase, including what is delivered, when, and by whom;
  • publish accurate refund, cancellation, return, shipping, and delivery policies, and honor them;
  • obtain the Visitor’s express informed consent before charging any payment method; and
  • provide accurate business identification and working contact details for customer service.

Where a Funnel sells a subscription, free trial, negative-option offer, continuity program, or any recurring charge, you must additionally:

  • disclose the recurring nature of the charge, the amount, the billing frequency, and the renewal terms clearly and conspicuously, immediately adjacent to the point of consent;
  • obtain separate affirmative consent to the recurring charge, not merely acceptance of general terms;
  • where a free or discounted trial is offered, disclose when it ends, what will be charged, and how to cancel before being charged;
  • send a retainable acknowledgment of the terms after purchase; and
  • provide a simple, timely cancellation mechanism that is at least as easy to use as the mechanism by which the Visitor subscribed.

You must not use the Services for forced continuity, undisclosed upsells or downsells, unauthorized rebills, or any billing practice designed to make cancellation difficult.

6. Prohibited and Restricted Industries

6.1 Prohibited. The Services may not be used for: adult content or services; illegal drugs, cannabis products where not lawful in every jurisdiction targeted, or drug paraphernalia; firearms, weapons, ammunition, or explosives; unlicensed gambling, betting, casino, sports wagering, or lottery operations; payday, title, or predatory lending; credit repair or credit washing services making unlawful claims; debt elimination or mortgage relief schemes; unregistered securities or investment offerings; binary options; unlicensed money transmission or virtual currency exchange; counterfeit or replica goods; unauthorized pharmaceuticals or prescription drugs; academic ghostwriting or essay mills; hacking or surveillance tools; fake identification or documents; multi-level marketing or network marketing programs of any kind; and any “get rich quick,” guaranteed-income, or business-opportunity offer prohibited by applicable law.

6.2 Restricted. The following require our prior written approval, and we may impose conditions, require documentation of licensure, or decline in our sole discretion: dietary supplements and nutraceuticals; weight loss and cosmetic products; health, wellness, and medical services; insurance; financial coaching, trading education, and investment education; cryptocurrency and digital assets; telemedicine; legal services; charitable and political fundraising; subscription boxes and continuity offers; and lead generation for any of the above.

6.3 We may add to or amend these lists at any time. Where a category is added, we may require you to cease the relevant use within a period we specify, and we may terminate if you do not.

7. Email, SMS, and Other Messaging

7.1 You must not use the Services, or any data collected through them, to send unsolicited bulk or commercial messages.

7.2 Where you send email, SMS, voice, or other electronic messages to contacts collected through a Funnel, you must comply with all applicable law, including as applicable the U.S. CAN-SPAM Act, the Telephone Consumer Protection Act, state telemarketing and messaging laws, the EU and UK GDPR and ePrivacy rules, and Canada’s Anti-Spam Legislation.

7.3 You must not: harvest, scrape, purchase, rent, or otherwise obtain contact lists without valid consent; use false or misleading headers, sender names, subject lines, or routing information; fail to honor an opt-out promptly; message any number on an applicable do-not-call registry without a valid exemption; or use automated dialing or prerecorded messages without required consent.

7.4 You must not configure a Funnel to enroll a Visitor in marketing communications without clear disclosure and, where required, separate affirmative consent.

8. Data Collection and Privacy

8.1 You must publish an accurate, accessible, and legally compliant privacy notice on every Funnel, together with any other legally required notices.

8.2 You must establish a lawful basis for all processing, obtain all consents required for cookies, pixels, and tracking technologies, and honor Visitor data subject and consumer rights requests.

8.3 You must not collect or transmit through the Services any of the following: government-issued identification numbers, including Social Security, passport, and driver’s license numbers; financial account numbers or credentials; passwords, security questions, or authentication credentials; biometric or genetic data; health, medical, or mental health information; information about criminal convictions or offenses; precise geolocation; information about children under 16; or any other special category of data under applicable law. This restriction applies regardless of any consent obtained.

8.4 You must not collect information by deception, or collect more than is disclosed to and reasonably expected by the Visitor.

8.5 You must not use the Services to build surveillance, tracking, or profiling tools directed at individuals without their knowledge.

9. Payment and Order Forms

9.1 Funnel payment and order forms transmit Visitor payment information directly from the Visitor’s browser to the third-party service you designate. You must not configure, modify, proxy, intercept, log, or add code to any Funnel in a manner that causes payment card data to be transmitted to, stored on, cached by, or accessible to Subscribe Funnels systems.

9.2 You must not store payment card data, security codes, or full magnetic stripe data in any field, file, note, form submission, or custom object within the Services.

9.3 You are responsible for your own obligations under the Payment Card Industry Data Security Standard and all applicable card network rules, and for the compliance and security of the payment service you select.

9.4 You must not use the Services in connection with transaction laundering, factoring, or processing payments on behalf of any other business, or to conceal the true nature of a transaction from a payment processor or acquirer.

9.5 You must maintain chargeback and dispute rates within the thresholds set by applicable card networks. Excessive chargebacks attributable to your Funnels are a violation of this Policy.

10. Technical and Security Restrictions

You must not:

  • upload, host, link to, or transmit any virus, worm, trojan, ransomware, spyware, keylogger, cryptominer, or other malicious code;
  • attempt to gain unauthorized access to the Services, to any account, or to any system or network connected to them;
  • probe, scan, penetration test, load test, or otherwise test the vulnerability of the Services without our prior written authorization;
  • circumvent, disable, or interfere with any authentication measure, usage limit, rate limit, or security feature;
  • conduct or facilitate any denial of service attack, or generate traffic intended to degrade the Services;
  • scrape, crawl, harvest, or use automated means to extract data from the Services, except through documented APIs within their published limits;
  • reverse engineer, decompile, or disassemble any part of the Services;
  • interfere with any other subscriber’s use of the Services or access another subscriber’s data; or
  • add custom code to a Funnel that is malicious, that redirects Visitors deceptively, that exfiltrates data to an undisclosed destination, or that compromises the security of the Services or of any Visitor’s device.

11. Resource Use and Fair Use

11.1 You must not use the Services in a manner that places an unreasonable or disproportionate burden on our infrastructure, or that degrades performance for other subscribers.

11.2 You must not use the Services primarily as a file storage service, content delivery network, media hosting service, backup service, proxy, or bandwidth source for content not integral to your Funnels.

11.3 You must not create multiple accounts to evade limits, pricing, suspension, or termination, or to obtain additional free trials.

11.4 You must not resell, sublicense, or provide access to the Services to third parties except as expressly permitted by your plan or by a white-label arrangement we have approved in writing.

11.5 Where your plan is described as offering unlimited or unmetered capacity, that description is subject to fair and reasonable use consistent with normal operation of a funnel business. We may contact you regarding disproportionate use and, where it continues, impose limits or require an upgrade.

12. Intellectual Property and Impersonation

12.1 You must hold all rights necessary for every element of Subscriber Content, including text, images, video, audio, fonts, code, and templates.

12.2 You must not use another party’s trademark, logo, brand name, or trade dress in a manner likely to cause confusion, including in domain names, page titles, or advertising.

12.3 You must not impersonate any person or entity, or falsely state or imply an affiliation, endorsement, partnership, or sponsorship, including with Subscribe Funnels.

12.4 You must not copy a third party’s website, funnel, sales copy, or design in a manner that infringes their rights.

12.5 Copyright complaints are handled under our Copyright and Takedown Policy. We terminate the accounts of repeat infringers.

13. Enforcement

13.1 We may take any of the following actions, at our sole discretion, immediately and without prior notice: issue a warning; remove, disable, or unpublish any content or Funnel; restrict features; suspend or terminate any account, including a White-Label Partner account or any End Client account beneath it; withhold or forfeit affiliate commissions; retain fees already paid; and report the matter to law enforcement, a regulator, or an affected third party.

13.2 The action we take need not be proportionate to the severity of the violation, and we may terminate for a first violation. We may act on a good-faith belief that a violation has occurred, whether or not one is later established.

13.3 We are under no obligation to give notice, to explain our reasoning, to allow an opportunity to cure, or to preserve or return any content. Where we do allow a cure period, doing so does not waive our right to act immediately on any other occasion.

13.4 No refund or credit is due in respect of any suspension or termination under this Policy, and outstanding amounts remain payable.

13.5 Where we act against a White-Label Partner, the effect may extend to that Partner’s End Clients and their Funnels. Where we act against an End Client, we may do so directly without routing the matter through the Partner.

13.6 You are liable to us for all costs, losses, fines, penalties, assessments, and expenses we incur as a result of your violation, including card network assessments, regulatory penalties, and the costs of responding to complaints and investigations. The indemnity in the Terms of Service applies.

13.7 Nothing in this Policy limits any other right or remedy available to us.

14. Reporting a Violation

14.1 To report content or conduct that may violate this Policy, contact [email protected]. Please include the URL of the Funnel concerned, a description of the issue, and your contact details.

14.2 We review reports we receive but do not guarantee any particular outcome, response time, or communication regarding the action taken. We may decline to act, and we may disclose the substance of a report, and your identity where legally required, to the subscriber concerned or to a regulator, law enforcement body, or court.

14.3 Copyright complaints should be submitted under the Copyright and Takedown Policy rather than through this route.

15. Changes to This Policy

15.1 We may amend this Policy at any time by posting an updated version with a revised “Last updated” date. Because this Policy addresses harmful and unlawful conduct, amendments take effect immediately on posting and we are not required to give advance notice.

15.2 Continued use of the Services after an amendment constitutes acceptance. You should review this Policy periodically.
